INVITATION TO TREAT
www.jdmtackle.com reserves the right to accept or refuse customer's offers to buy. The display of goods on this site amounts to an invitation to treat only and is not an offer to sell goods at any price indicated. No contract for the supply of goods will be deemed to exist between you and www.jdmtackle.com unless, and until, an email is sent by www.jdmtackle.com to you to confirm that your order has been shipped.
This confirmation e-mail amounts to an acceptance by www.jdmtackle.com of your offer to buy goods from www.jdmtackle.com and this acceptance is effective regardless of whether or not you receive the e-mail.
www.jdmtackle.com is free to withdraw from a prospective contract at any time prior to acceptance. This also applies in the case of any error or inaccuracy in respect of the goods, any description applied to the goods, the availability of the goods or the order itself.
REPRESENTATION OF GOODS
www.jdmtackle.com will do our utmost to represent the closest color in the photographs, to the actual products. However, colors of photographs may vary from the real products due to calibration.
INDEMNITY
You agree to indemnify, defend and hold harmless www.jdmtackle.com and it's Providers from and against all losses, expenses, damages and costs arising from any violation of these Terms of use, any activity related to your account (including infringement of third parties'
intellectual property rights) or which or which arises from negligence, omission or fraud on your part or any other person who accesses www.jdmtackle.com using your account service. You also agree to waive all claims you may have against www.jdmtackle.com and its Providers for any losses or damages you may sustain in connection in using www.jdmtackle.com.
LIMITATION OF LIABILITY
Neither www.jdmtackle.com nor any of its directors, employees or other representatives will be liable for damages arising out of or in connection with the use of this site.
www.jdmtackle.com does not limit its liability for death or personal injury to the extent only that it arises as a result of negligence of JDM Tackle, its directors, employees or other representatives.
www.jdmtackle.com does not accept liability (except as set out
below) for any errors or omissions and reserves the right to change information, specifications and descriptions of listed goods, products and services.
www.jdmtackle.com does not accept liability for any indirect loss, consequential loss, loss of data, loss of income or profit, loss of or damage to property and/or loss from claims of third parties arising out of the use the www.jdmtackle.com website or for any products purchased from the www.jdmtackle.com website. www.jdmtackle.com will only be liable for direct loss up to a maximum total of the price of the product purchased in respect of any claim.
RETURN POLICY
If for any reason you are not 100% satisfied with your purchase, please contact us within 7 days of purchase. All returns must be accompanied with a RMA (Return Merchandise Authorization), please email or call for return authorization, we will not accept returns WITHOUT RMA. Returns for other than warranty issues will be subject to a 15% restocking charge. All returned merchandise must be accompanied with receipt, unused, in undamaged original packaging and in resalable condition.
Shipping cost for return merchandise will be at buyers care.
Sale, Closeout and Used items do not qualify for returns.
TAX & DUTIES
Customers will be liable for tax and duties of their home state or country. All purchase in the state of California will be taxed accordingly.
